Overview

Welcome to Tolvoria. Throughout these Terms of Service, the terms “we”, “us” and “our” refer to Tolvoria.

Tolvoria operates the Tolvoria website, online shop and Tolvoria mobile application (“Tolvoria App”), together with related information, stories, characters, digital content, games, activities, features, tools, physical products, digital products and services.

The website, online shop, Tolvoria App and all related Tolvoria services are collectively referred to in these Terms as the “Services.”

Our online shop is hosted by Shopify, which enables us to provide our online shopping services. The Tolvoria App may be distributed through third-party platforms, including Apple’s App Store, and may use third-party technology providers to deliver certain functionality.

These Terms of Service, together with our Privacy Policy and any other policies referred to in them (collectively, the “Terms”), explain your rights and responsibilities when using the Services.

Please read these Terms carefully.

By accessing, downloading, installing, purchasing from or using any of the Services, you agree to these Terms and our Privacy Policy.

If you do not agree to these Terms or our Privacy Policy, you must not use the Services.

Section 1 – Access, Accounts and Children

By agreeing to these Terms, you confirm that you have reached the age required to enter into this agreement in your country or place of residence, or that use by a minor takes place with appropriate permission or supervision from a parent or legal guardian where required.

Tolvoria creates physical and digital experiences that may be enjoyed by children. Where a child uses the Tolvoria App, a parent or guardian is responsible for authorising the child’s use where required by applicable law.

Purchasing functions intended for adults should only be used or authorised by an adult or in accordance with the applicable rules of the relevant app marketplace.

If an account is available, you are responsible for keeping your account details secure and for activity carried out through your account.

You must provide accurate and current information where information is required to provide a Service.

You may not sell, transfer or otherwise provide your account to another person except where expressly permitted by Tolvoria.

Section 2 – The Tolvoria App

The Tolvoria App forms part of the Tolvoria Services.

The App may include features such as:

• Tolvoria stories and world-building
• The twelve Tolvoria Guardians
• Interactive experiences
• Games and activities
• The Heart of the Year
• Calendar-based experiences
• Collectibles and discoveries
• Guardian interactions
• Puzzles and challenges
• Educational or imaginative content
• Seasonal or date-based content
• Digital rewards or progress
• Other Tolvoria features introduced over time

Some features may change, expand or be replaced as the Tolvoria universe develops.

Certain content may only be available at particular times, after completing activities, through a particular Guardian or month, or after meeting other conditions presented within the App.

Tolvoria may update the App to improve functionality, security, compatibility, content or user experience.

Availability of individual features is not guaranteed permanently.

Section 3 – App Store and Third-Party Platforms

The Tolvoria App may be downloaded or distributed through third-party app marketplaces, including Apple’s App Store.

Your use of an app marketplace is also subject to that marketplace’s own terms and policies.

Where the Tolvoria App is downloaded through Apple’s App Store, you acknowledge that these Terms are between you and Tolvoria and not between you and Apple, except for rights or obligations imposed by Apple’s applicable terms.

Apple is not responsible for providing maintenance or support for Tolvoria except where required under Apple’s applicable rules or law.

Nothing in these Terms limits any rights you have under mandatory consumer law or applicable terms imposed by the platform through which you obtained the App.

Section 4 – Physical and Digital Products

Tolvoria may offer physical products, digital products, App functionality and other Tolvoria experiences.

We take reasonable care to describe Tolvoria products accurately.

However, colours and appearance may vary depending on screen settings, device configuration, manufacturing processes and materials.

Digital content may also appear differently depending on device, operating system, screen size and App version.

Product descriptions, App content and available functionality may be updated where appropriate.

We reserve the right to discontinue products, features or content subject to applicable consumer law.

Section 5 – Orders

When you place an order through the Tolvoria online shop, you are making an offer to purchase.

Tolvoria may accept or decline an order in accordance with applicable law.

An order is accepted when Tolvoria provides confirmation of acceptance.

Payment must be successfully processed before an order can be completed where payment is required.

Please check your order carefully before submitting it.

Physical purchases may be returned or exchanged in accordance with our Refund Policy and applicable consumer law.

Section 6 – App Purchases, Digital Content and Subscriptions

The Tolvoria App may offer paid functionality, digital content, subscriptions or other purchases.

Where a purchase is made through Apple’s App Store or another app marketplace, payment processing is handled by that platform or its authorised payment provider.

Prices, billing periods and applicable conditions will be displayed before a purchase is completed.

Where a subscription is offered, information about its duration, price and renewal conditions will be presented before purchase.

Subscriptions purchased through an app marketplace are generally managed through the user’s account with that marketplace.

Refunds for purchases processed by an app marketplace may be subject to the marketplace’s refund procedures and applicable consumer law.

Nothing in these Terms removes rights that cannot legally be waived.

Section 7 – Prices and Billing

Prices, discounts and promotions may change without notice, except where a price has already become binding for a completed transaction.

The applicable price will be displayed before purchase.

Additional costs such as delivery charges or applicable taxes will be displayed where required.

Prices available through the Tolvoria website may differ from prices available through an app marketplace or other sales channel because of platform requirements, taxes, promotions or other legitimate reasons.

Section 8 – Shipping and Delivery

This section applies to physical Tolvoria products.

Any stated delivery time is an estimate unless expressly stated otherwise.

Delays may occur because of carriers, customs procedures or circumstances outside Tolvoria’s reasonable control.

Nothing in this section limits mandatory consumer rights.

Section 9 – Intellectual Property

The Tolvoria universe and Services contain intellectual property belonging to Tolvoria or its licensors.

This includes, where applicable:

• “TWELVE MONTHS OF MAGIC”
• “Where the Months Are Made”
• The twelve Tolvoria Guardians
• Guardian names and identities
• Character designs
• Tolvoria Castle
• The Heart of the Year
• Stories and story concepts
• Illustrations
• Artwork
• Graphics
• Animations
• Games
• App interfaces
• Sounds and audio
• Text
• Photographs
• Product designs
• Packaging
• Logos
• Symbols
• Digital content
• Website content

These materials are protected by applicable copyright, trademark and other intellectual-property laws.

Your use of the Services does not transfer ownership of Tolvoria intellectual property to you.

You may use Tolvoria content only for personal, non-commercial purposes unless Tolvoria has expressly given written permission for another use.

You must not reproduce, distribute, copy, modify, sell, commercially exploit, republish or create derivative commercial products from protected Tolvoria material except where permitted by law or expressly authorised by Tolvoria.

All rights not expressly granted remain reserved by Tolvoria.

Section 10 – App Licence

Subject to compliance with these Terms, Tolvoria grants you a limited, personal, non-exclusive, non-transferable and revocable right to install and use the Tolvoria App on compatible devices that you own or control, subject to applicable app marketplace rules.

This licence is provided solely for personal and non-commercial use.

You may not:

• Copy the App except where technically necessary or legally permitted
• Sell or redistribute the App
• Attempt to obtain unauthorised access to App systems
• Circumvent security mechanisms
• Interfere with App operation
• Extract protected Tolvoria content for commercial use
• Reverse engineer the App except where such restriction is prohibited by applicable law
• Use the App or its content to create an unauthorised competing product or service

Section 11 – Optional Tools and Third-Party Services

Some Tolvoria Services may interact with technology or services provided by third parties.

Third-party services may operate under their own terms and privacy policies.

Tolvoria is not responsible for independent third-party services beyond the extent required by applicable law.

We may introduce additional features, tools and resources in the future. Unless otherwise stated, they will form part of the Services and be subject to these Terms.

Section 12 – Privacy

Personal information processed through the Tolvoria website, online shop and Tolvoria App is governed by our Privacy Policy.

Our Privacy Policy explains, among other things, how information may be collected and processed through:

• The Tolvoria website
• The Tolvoria online shop
• The Tolvoria App
• Purchases and transactions
• Accounts where available
• App functionality
• Technical and diagnostic systems
• Communications with Tolvoria

Because our online shop is hosted by Shopify, certain online-shop information may also be processed by Shopify according to its applicable privacy practices.

Section 13 – Feedback

If you voluntarily submit ideas, suggestions, reviews or other feedback concerning Tolvoria or the Services, Tolvoria may use that feedback for legitimate purposes, including improving our products and Services, subject to applicable law.

You must not submit material that infringes another person’s rights or contains unlawful, malicious or harmful content.

Section 14 – Errors, Availability and Updates

The Services may occasionally contain errors, inaccuracies, technical problems or omissions.

We may correct errors and update information where appropriate.

The Tolvoria App may require updates to continue operating correctly on supported devices and operating systems.

We cannot guarantee that every device or operating-system version will remain supported indefinitely.

Section 15 – Prohibited Uses

You may use the Services only for lawful purposes.

You must not use the Services to:

• Violate applicable law
• Infringe Tolvoria’s or another person’s intellectual-property rights
• Harass, threaten or harm another person
• Submit intentionally false or misleading information
• Distribute malware or malicious code
• Attempt unauthorised access
• Circumvent security mechanisms
• Disrupt the operation of the App or website
• Collect personal information about other users without authorisation
• Conduct phishing or fraudulent activity
• Commercially scrape or systematically extract Tolvoria content without permission
• Impersonate another person or organisation
• Exploit the Services in a way that harms Tolvoria or its users

We may restrict or terminate access where we reasonably believe these Terms have been materially breached.

Section 16 – Automated Systems and AI

You must not use automated tools, scraping systems, bots, AI agents or similar technology to systematically extract, reproduce or commercially exploit protected Tolvoria content unless Tolvoria has provided permission or applicable law expressly permits the activity.

Nothing in this section restricts rights that cannot lawfully be restricted.

Section 17 – Termination and Account Deletion

You may stop using the Tolvoria Services at any time.

Where the Tolvoria App supports user accounts, users may request deletion of their account in accordance with the functionality or instructions provided by Tolvoria.

Tolvoria may suspend or terminate access where permitted by applicable law, including where these Terms have been materially breached or where necessary to protect the security of the Services or other users.

Sections that by their nature should survive termination will remain effective.

Section 18 – Disclaimer of Warranties

We aim to provide reliable, enjoyable and high-quality Tolvoria Services.

However, digital Services can occasionally experience interruptions, errors, maintenance requirements or compatibility problems.

To the fullest extent permitted by applicable law, the Services are provided “as is” and “as available.”

Nothing in these Terms excludes warranties or consumer rights that cannot lawfully be excluded.

Section 19 – Limitation of Liability

To the fullest extent permitted by applicable law, Tolvoria and its relevant service providers will not be responsible for indirect, incidental, special or consequential losses arising from use of the Services where such liability may lawfully be excluded.

Nothing in these Terms excludes or limits liability where doing so would be unlawful.

Nothing in these Terms limits mandatory rights available to consumers.

Section 20 – Indemnification

To the extent permitted by applicable law, you agree to be responsible for third-party claims resulting from your unlawful use of the Services, material breach of these Terms or infringement of another person’s rights.

This section does not impose liability on consumers where such liability would be prohibited by applicable law.

Section 21 – Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue to apply.

The affected provision will be interpreted or limited to the extent necessary to comply with applicable law.

Section 22 – Entire Agreement

These Terms, together with our Privacy Policy and other applicable policies, constitute the agreement between you and Tolvoria concerning your use of the Services.

They replace previous terms concerning the same subject matter to the extent permitted by law.

Section 23 – Governing Law

These Terms and any separate agreement through which Tolvoria provides Services are governed by Danish law, without limiting mandatory consumer protections available to you under the law applicable in your country of residence.

Disputes will be handled by the competent Danish courts unless mandatory consumer law provides otherwise.

Section 24 – Changes to the Services and Terms

Tolvoria may continue to develop the Tolvoria universe, website, shop and App.

This may include introducing, modifying or removing:

• Features
• Games
• Activities
• Guardian experiences
• Stories
• Digital content
• Seasonal experiences
• Technical functionality

We may also update these Terms when our Services, business practices, technology or legal obligations change.

Where required by law, users will receive appropriate notice of material changes.

The current version of these Terms will be made available through the relevant Tolvoria Services.
