Overview

Welcome to Tolvoria. Throughout these Terms of Service, the terms “we”, “us” and “our” refer to Tolvoria.

Tolvoria operates this online shop and website, including all related information, content, features, tools, products and services, to offer you a carefully curated shopping experience (collectively, the “Services”). Our store is hosted by Shopify, which enables us to provide the Services to you.

These Terms of Service, together with any policies referred to in them (collectively, the “Terms”), explain your rights and responsibilities when you use our Services.

Please read these Terms carefully. They contain important information about your legal rights, including disclaimers and limitations of liability.

By visiting, interacting with or using our Services, you agree to be bound by these Terms and our [Privacy Policy]. If you do not agree to these Terms or our Privacy Policy, you must not access or use the Services.

We take great care to present Tolvoria products as accurately as possible. However, colours and appearance may vary depending on the device, screen settings and configuration you use to view our shop.

We cannot guarantee that the appearance or quality of a product will meet every personal expectation or be completely identical to how it appears on a screen.

Product descriptions may be updated at any time without notice. We reserve the right to discontinue a product and, where appropriate, to limit the quantity available to a particular person, geographical area or jurisdiction.

Section 3 – Orders

When you place an order, you are making an offer to purchase. Tolvoria reserves the right to accept or decline an order in accordance with applicable law. Your order is accepted only when Tolvoria sends confirmation of acceptance. Payment must be received and processed before an order can be accepted.

Please check your order carefully before submitting it. Once an order has been accepted, we may not be able to accommodate a cancellation request. If we decline, amend or cancel an order, we will try to notify you using the email address, billing address or telephone number provided when the order was placed.

Purchases may only be returned or exchanged in accordance with our [Refund Policy].

Section 4 – Prices and Billing

Prices, discounts and promotions may change without notice. The price charged will be the price shown when the order is placed and will appear in your order confirmation. Taxes are handled as displayed at checkout and in accordance with applicable law.

You agree to provide accurate, complete and up-to-date purchase, payment and account information. You must promptly update relevant information, including your email address and payment-card details, so that we can complete transactions and contact you when needed.

You represent and warrant that the payment information you provide is accurate and complete, that you are authorised to use the selected payment method, and that you will pay all valid charges associated with your order, including applicable delivery fees and taxes.

Any stated delivery time is an estimate and cannot be guaranteed. Delays may occur because of carriers, customs processing or events outside our reasonable control.

Nothing in this section limits any mandatory rights you may have under applicable consumer law. Responsibility for the goods passes in accordance with the law that applies to your order.

Section 6 – Intellectual Property

The Services, including Tolvoria’s names, stories, characters, trademarks, branding, text, photographs, illustrations, graphics, product reviews, video, audio, designs and the selection and arrangement of this material, belong to Tolvoria, our affiliates or our licensors. They are protected by applicable copyright, trademark and other intellectual-property laws.

These Terms allow you to use the Services for personal, non-commercial purposes only. Without our prior written permission, you may not reproduce, distribute, modify, create derivative works from, publicly display, publicly perform, republish, download, store or transmit material from the Services, except where this is permitted by law.

Nothing in these Terms grants you a licence or other right to any patent, trademark, copyright or other intellectual property belonging to Tolvoria, Shopify or a third party unless expressly stated. Unauthorised use may violate intellectual-property law. All rights not expressly granted are reserved by Tolvoria.

The Tolvoria name, logo, character names, product names, designs and slogans are trademarks or other protected identifiers belonging to Tolvoria or its licensors. They may not be used without Tolvoria’s prior written permission. Shopify’s names, logos, product names, designs and slogans belong to Shopify. Other names, logos and trademarks displayed through the Services belong to their respective owners.

Section 7 – Optional Tools

The Services may provide access to tools supplied by third parties. We do not monitor or control these tools and provide access to them “as is” and “as available”, without endorsement or warranties of any kind.

Your use of optional third-party tools is at your own discretion and risk. You should review and accept the terms under which the relevant provider supplies each tool.

We may introduce new features, tools or resources in the future. They will form part of the Services and will be subject to these Terms.

Section 8 – Third-Party Links

The Services may contain content, features or links provided or operated by third parties. We are not responsible for examining or verifying the content or accuracy of third-party websites or materials that you choose to access. If you leave our Services to visit a third-party website, you do so at your own risk.

To the extent permitted by law, Tolvoria is not responsible for loss or damage connected with your access to a third-party website or your purchase or use of third-party products, services, resources or content. Review the third party’s policies and procedures carefully before entering into a transaction. Questions, concerns or claims about third-party products or services should be directed to the relevant third party.

Section 9 – Our Relationship with Shopify

Tolvoria is hosted by Shopify, which enables us to provide the Services. However, purchases made through our store are transactions directly between you and Tolvoria.

By using the Services, you acknowledge that Shopify is not responsible for the sale between you and Tolvoria, including injury, damage or loss arising from products or services purchased from Tolvoria. To the extent permitted by applicable law, you release Shopify and its affiliates from claims and liabilities arising from or connected with your purchases and transactions with Tolvoria.

Section 10 – Privacy Policy

Personal information collected through the Services is governed by our [Privacy Policy]. Certain information may also be governed by Shopify’s Privacy Policy. By using the Services, you acknowledge that you have read these policies.

This may include operating, evaluating, improving and promoting the Services.

You confirm that you own the Feedback or have all rights necessary to submit it, that you have disclosed any compensation or incentive connected with it, and that it complies with these Terms.

Unless required by law, we are not obliged to keep Feedback confidential, pay compensation for it or respond to it. We may monitor, edit or remove Feedback that we consider unlawful, offensive, threatening, defamatory, obscene, infringing or otherwise inappropriate.

Your Feedback must not violate another person’s rights, including copyright, trademark, privacy or personality rights. It must not contain unlawful, abusive or obscene material, malware or computer viruses. You must not use a false email address, impersonate another person or mislead us or others about the origin of Feedback. You are responsible for the Feedback you provide and its accuracy.

Section 12 – Errors, Inaccuracies and Omissions

Information within the Services may occasionally contain typographical errors, inaccuracies or omissions relating to matters such as product descriptions, prices, promotions, offers, delivery charges, transit times or availability.

We reserve the right to correct errors, inaccuracies or omissions and to update information or cancel an affected order where information is inaccurate, including after an order has been submitted, subject always to applicable law.

Section 13 – Prohibited Uses

You may access and use the Services only for lawful purposes. You must not use the Services, directly or indirectly:

• for any unlawful or malicious purpose;

• to violate applicable international, national or local laws or regulations;

• to infringe our intellectual-property rights or the rights of another person;

• to harass, abuse, insult, harm, defame, intimidate or discriminate against another person;

• to submit false or misleading information;

• to upload, download, send, receive, use or reuse material that does not comply with these Terms;

• to distribute unsolicited advertising or promotional material, including spam, chain letters or similar solicitations;

• to impersonate another person or organisation; or

• to interfere with another person’s use of the Services or to behave in a way that may harm Tolvoria, Shopify or users of the Services.

You also agree not to upload malware or malicious code, reproduce or commercially exploit any part of the Services without permission, collect or track another person’s personal information, engage in phishing or similar abuse, or interfere with security and access controls.

You must not use robots, spiders, scraping tools, data-extraction tools, automated devices, AI agents or other automated or manual methods to access or extract material from the Services except where expressly permitted by us or required by law.

We may suspend, restrict or terminate access where we reasonably believe these Terms have been breached.

Section 14 – Agents

This section applies if you use, permit, activate or deploy an autonomous or semi-autonomous software service (an “Agent”) to access, use or interact with the Services on your behalf.

An Agent may only access or interact with the Services when it clearly identifies itself and complies with the requirements below. It must not access or interact with the Services if Tolvoria has instructed it not to do so.

We may use technical measures to control whether and how Agents access or interact with the Services.

Agents must:

• identify every HTTP or HTTPS request as originating from an Agent and include the Agent’s name in the user-agent string in the format “Agent/[agent name]”;

• not conceal that an interaction originates from an Agent, imitate human behaviour to evade detection or bypass CAPTCHA or similar measures;

• answer truthfully when asked whether an interaction originates from a person or a computer; and

• not bypass measures designed to block, limit or control Agent access.

Section 15 – Termination

We may terminate these Terms or restrict your access to all or part of the Services where permitted by applicable law. You remain responsible for valid amounts due up to and including the date of termination.

Provisions that by their nature should continue after termination will remain in effect. These include provisions concerning intellectual property, Feedback, termination, disclaimers, limitations of liability, indemnification, severability, waiver, the entire agreement, assignment, governing law and privacy.

Section 16 – Disclaimer of Warranties

Information presented through the Services is provided for general information. Although we aim to keep it accurate and helpful, we do not guarantee that all information will always be complete, current or suitable for every purpose.

To the fullest extent permitted by law, and unless Tolvoria expressly states otherwise, the Services and products made available through them are provided “as is” and “as available”, without warranties, representations or conditions beyond those that cannot lawfully be excluded.

We do not guarantee that use of the Services will always be uninterrupted, timely, secure or error-free. Some jurisdictions do not permit the exclusion of certain warranties, so parts of this section may not apply to you. Nothing in these Terms excludes or limits mandatory consumer rights.

Section 17 – Limitation of Liability

To the fullest extent permitted by law, Tolvoria, our affiliates, partners, directors, officers, employees, agents, contractors, service providers and licensors, and Shopify and its affiliates, will not be liable for indirect, incidental, punitive, special or consequential loss arising from your use of the Services or products purchased through them, including loss of profits, revenue, savings or data.

Nothing in these Terms excludes or limits liability where doing so would be unlawful, including any liability or consumer remedy that cannot be excluded under applicable law.

Section 18 – Indemnification

To the extent permitted by law, you agree to indemnify and hold harmless Tolvoria, Shopify and our respective affiliates, partners, officers, directors, employees, agents, contractors, licensors and service providers from third-party claims, losses, liabilities and reasonable legal fees arising from your material breach of these Terms, your violation of applicable law or another person’s rights, or your unlawful use of the Services.

We will provide reasonable notice of an eligible claim. A delay in notice will not release you from your obligations unless it causes material prejudice. Where permitted, we may manage the defence and settlement of a claim at your expense, but we will not agree to a settlement requiring a non-financial obligation from you without your reasonable consent. You agree to cooperate with the defence of an eligible claim, including by providing relevant documents.

Section 19 – Severability

If any provision of these Terms is found to be unlawful, invalid or unenforceable, it will be enforced to the fullest extent permitted by law. The unenforceable portion will be treated as severed without affecting the validity and enforceability of the remaining provisions.

Section 20 – Waiver and Entire Agreement

Our failure to exercise or enforce a right or provision under these Terms does not constitute a waiver of that right or provision.

These Terms, together with the policies and operating rules published through the Services, form the entire agreement between you and Tolvoria regarding your use of the Services. They replace previous or contemporaneous agreements, communications and proposals relating to that use, whether oral or written.

Any ambiguity in the interpretation of these Terms will not automatically be interpreted against the party that drafted them.

Section 21 – Assignment

You may not transfer or assign these Terms or your rights or obligations under them without our prior written consent. Any attempted transfer without consent will be invalid. Tolvoria may transfer or delegate these Terms and our rights and obligations where permitted by applicable law.

Section 22 – Governing Law

These Terms and any separate agreement through which Tolvoria provides Services are governed by Danish law, without limiting any mandatory consumer protections that apply in your country of residence.

Any dispute will be handled by the competent Danish courts unless mandatory consumer law gives you the right to bring proceedings elsewhere.

Headings are included for convenience only and do not limit or otherwise affect the meaning of these Terms.

Section 24 – Changes to These Terms

You can review the current version of these Terms on this page at any time.

We may update, amend or replace parts of these Terms by publishing changes on our website. Where required by law, we will notify you of material changes. Changes will take effect on the date stated in the notice. Your continued use of the Services after the effective date constitutes acceptance of the updated Terms, where permitted by law.
